CAST-A-WAY DIGITAL SERVICES – TERMS OF SERVICE

 

1. Company Identification – Cast-A-Way Cruise and Resort Hiring Agency Inc., a corporation duly organized and existing under the laws of Ontario, Canada, with registered address at:

2. Definitions – For purposes of these Terms:
“Company” refers to Cast-A-Way Cruise and Resort Hiring Agency Inc.
“User” refers to any individual purchasing or accessing digital services.
“Services” refers collectively to VIP Membership, Resume Production, Visa Assistance, and Flight Booking Assistance.
“Purchase” refers to any confirmed payment processed through an authorized payment gateway.
“Access Link” refers to a unique, single-use link issued for VIP access.

3. Scope of Digital Services – These Terms of Service apply to the following independent digital services offered by Cast-A-Way Cruise and Resort Hiring Agency Inc.:
• VIP Digital Membership
• Resume Production and Customization Services
• Visa Application Assistance (including D-160 support)
• Flight Booking Assistance
These services are independent from Cast-A-Way’s recruitment operations and do not form part of any official hiring process. These Terms apply exclusively to digital services and do not govern recruitment operations.

IMPORTANT NOTE:

Participation in the VIP does not guarantee a job, an interview, priority service, approval, or any specific professional result; nor does it alter the official recruitment process. The VIP membership is not and will not be a part of the hiring process to avoid any violation breach to Regulation 1.4 sub section 5a and 5b of MLC.

The same principle applies to all other digital services offered by Cast-A-Way, including Resume Production and Customization Services, Visa Application Assistance (including D-160 completion support), and Flight Booking Assistance. None of these services guarantee employment, interviews, visa approval, airline confirmation, recruitment priority, governmental approval, or any specific professional or travel-related outcome. These services are independent advisory and administrative support services and do not influence official recruitment decisions, government determinations, or airline policies. References to MLC regulations apply exclusively to maritime recruitment contexts and do not expand the scope of these digital services.

4. Acceptance of Terms – By checking the acceptance box and completing a purchase, the user declares that they have read, understood, and fully accepted these Terms of Service. Each purchase constitutes a legally binding electronic agreement.

5. VIP Digital Membership – The VIP Area is a digital service granting access to a private Telegram channel where content, templates, guidance, live sessions, and educational materials are made available. Access is provided via an individual, exclusive, single-use link sent to the email address provided at checkout. Responsibility for safeguarding this link rests solely with the user. Cast-A-Way is not responsible for:
• Incorrect email addresses
• Spam filtering
• Link misuse by third parties
• Technical or device-related issues
Sending the access link to the email provided constitutes full delivery of the service. Due to the digital nature and immediate access to exclusive content, VIP membership is non-refundable once payment is confirmed. Access duration corresponds strictly to the plan purchased and begins upon payment confirmation.

6. Resume Production Services – Resume services consist of formatting, structuring, and organizing content based strictly on information provided by the client. Cast-A-Way:
• Does not fabricate experience
• Does not guarantee interviews
• Does not guarantee employment
• Is not responsible for inaccuracies provided by the client
The client remains fully responsible for all information submitted. Once work has begun or draft materials have been delivered, the service is considered in execution and non-refundable. The Company does not verify the authenticity of documents provided by the client.

7. Visa Assistance Services – Visa assistance services include guidance and completion support for visa forms, such as the D-160, based exclusively on information provided by the client. Cast-A-Way:
• Is not affiliated with any government authority
• Does not guarantee visa approval
• Does not influence consular decisions
• Is not responsible for visa denials
The client is solely responsible for the accuracy and truthfulness of all submitted information. Errors resulting from incorrect or incomplete information provided by the client are the client’s responsibility. Visa assistance services are non-refundable once processing has begun. The Company does not provide legal advice.

8. Flight Booking Assistance – Flight booking assistance includes research, guidance, and support during the flight selection and booking process. Cast-A-Way:
• Is not an airline
• Is not responsible for airline schedule changes
• Is not responsible for cancellations or operational disruptions
• Does not control airline refund policies
Final ticket purchase confirmation and compliance with airline rules are the client’s responsibility. Once research and assistance have begun, the service is non-refundable. Ticket issuance is performed directly by the airline or authorized platform selected by the client.

9. Payments – All payments are processed through authorized third-party gateways such as Stripe. Cast-A-Way does not store credit card details. The service term begins at the moment payment is confirmed. Certain services may be limited in capacity and subject to availability. All transactions are subject to the terms and conditions of the respective payment processor.

10. No Refund Policy – Due to the digital, personalized, and advisory nature of the services provided:
• VIP access is non-refundable once access is granted
• Resume services are non-refundable once work begins
• Visa services are non-refundable once form processing begins
• Flight assistance is non-refundable once research begins

Refunds are not granted for:
• Change of mind
• Personal time constraints
• Technical issues on the client’s side
• Government decisions
• Airline decisions
• Misuse of access links
Purchase constitutes clear and unequivocal agreement with this policy. The User acknowledges that digital and advisory services begin upon confirmation of payment and may involve immediate resource allocation.

11. Intellectual Property –
All materials, templates, content, and guidance provided are protected by copyright and intended solely for personal use. Reproduction, redistribution, resale, recording, or public sharing is strictly prohibited and may result in immediate termination of service without refund.

12. User Conduct – Users agree to maintain respectful behavior and refrain from:
• Spam
• Fraud
• Disruptive behavior
• Misrepresentation
• Improper self-promotion
Violation may result in suspension or permanent removal of access without refund. The Company reserves the right to determine, at its sole discretion, whether conduct violates these Terms.

13. Modifications – The Company may modify these Terms, services, pricing, or operational structure at any time without prior notice. Continued use of the services after such modifications constitutes full acceptance of the revised Terms.

14. Limitation of Liability – Cast-A-Way shall not be liable for:
• Government decisions
• Visa denials
• Airline decisions
• Recruitment outcomes
• Technical failures beyond its control
• Indirect or consequential damages
In no event shall the Company’s total liability exceed the amount paid by the User for the specific service purchased. Under no circumstances shall the Company be liable for loss of profits, loss of opportunity, reputational damage, or travel disruption costs.

15. Force Majeure – The Company shall not be liable for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, government actions, internet outages, platform disruptions, airline operational changes, or payment processor failures.

16. Governing Law – These Terms are governed by the laws of Ontario, Canada.

17. Dispute Resolution – Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the services shall first be attempted to be resolved through good-faith informal negotiation between the parties. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to the competent courts of Ontario, Canada, which shall have exclusive jurisdiction. The User expressly waives any objection to venue or jurisdiction.

18. International Users and Legal Scope – The services are offered internationally. Users are responsible for ensuring that their use of the services complies with the laws of their respective jurisdictions. Nothing in these Terms shall be interpreted as creating any governmental representation, immigration advisory license, airline agency relationship, or recruitment authority beyond what is legally permitted under Canadian law.

19. Entire Agreement – These Terms constitute the entire agreement between the Company and the User regarding the digital services and supersede any prior communications, representations, or agreements, whether written or oral.

20. Severability – If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Service Commitment – The Company commits to perform the purchased Services with reasonable professional diligence and in accordance with the service description presented at the time of purchase.
